End User License Agreement

License Grant

Pickering Casino Resort grants you a limited, non-exclusive, non-transferable, revocable license to:

Use the Software

Install and use the Software on devices you own or control for personal hotel guest experience purposes.

Access the Service

Access and use room control features and hotel services in accordance with this agreement during your stay.

Personalize Your Experience

Save preferences and settings to personalize your room environment and access hotel amenities.

License Restrictions

You may NOT:

Copy, modify, or create derivative works of the Software

Reverse engineer, decompile, or disassemble the Software

Remove, alter, or obscure any proprietary notices on the Software

Use the Software for any commercial purpose without authorization

Use automated systems to access the service (bots, scrapers, etc.)

Interfere with or disrupt the Software or hotel systems

Use the Software in any unlawful manner

Attempt to access rooms or services not assigned to you

Intellectual Property

The Software is licensed, not sold. Pickering Casino Resort retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of Pickering Casino Resort.

We Own

All software code, algorithms, designs, graphics, text, and other content in the application.

You Own

Your personal preferences, settings, and any feedback you choose to provide about the Software.

User Data and Privacy

Your use of the Software is also governed by our Privacy Policy. We collect minimal data necessary to provide room control and hotel service features. By using the Software, you consent to such collection and processing.

Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICKERING CASINO RESORT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be uninterrupted, error-free, or free of viruses or other harmful components. Room control features depend on hotel infrastructure and may occasionally be unavailable.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PICKERING CASINO RESORT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination:

You must cease all use of the Software
You must delete or destroy all copies of the Software from your devices
Your saved preferences and settings may be removed

Updates and Modifications

Pickering Casino Resort may provide updates, patches, or modifications to the Software. These updates may be automatically downloaded and installed through the App Store. You acknowledge that the Software may require such updates to continue functioning properly. We reserve the right to modify this EULA at any time. Continued use of the Software after changes constitutes acceptance of the modified EULA.

Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Pickering Casino Resort operates, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
