This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Pickering Casino Resort for the Pickering Casino Resort software product ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
Important: By using Pickering Casino Resort, you acknowledge that you have read, understood, and agree to be bound by this EULA and our Privacy Policy.
Pickering Casino Resort grants you a limited, non-exclusive, non-transferable, revocable license to:
Install and use the Software on devices you own or control for personal hotel concierge purposes.
Access and use hotel services through the app in accordance with this agreement.
Use room credentials to access personalized features and hotel services.
You may NOT:
The Software is licensed, not sold. Pickering Casino Resort retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of Pickering Casino Resort.
All software code, algorithms, designs, graphics, text, and other content in the application.
Your personal data, preferences, and service requests made through the Software.
Your use of the Software is also governed by our Privacy Policy. We collect and process minimal data as described in our Privacy Policy. By using the Software, you consent to such collection and processing.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICKERING CASINO RESORT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Software will be uninterrupted, error-free, or free of viruses or other harmful components. Pickering Casino Resort is a hotel concierge tool and does not guarantee specific service availability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PICKERING CASINO RESORT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.
This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination:
Pickering Casino Resort may provide updates, patches, or modifications to the Software. These updates may be automatically downloaded and installed. You acknowledge that the Software may require such updates to continue functioning properly.
We reserve the right to modify this EULA at any time. Continued use of the Software after changes constitutes acceptance of the modified EULA.
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Pickering Casino Resort operates, without regard to its conflict of law provisions.
Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
